About Us

These Terms & Conditions govern the use of www.finchandhatton.co.uk and purchases made through the Site.

The Site is operated by Finch & Hatton Ltd.

References to “Finch & Hatton”, “we”, “us” or “our” mean Finch & Hatton Ltd. References to “you” mean the customer or Site user.

These terms are intended for customers purchasing as consumers. Please contact us separately regarding wholesale or business purchases.

Acceptance of These Terms

By placing an order, you agree to these Terms & Conditions together with our:

  • Delivery & Dispatch Policy.
  • Returns & Refunds Policy.
  • Privacy Notice.
  • Cookie Policy.
  • Product Use & Safety information.

Please read these documents before ordering.

Nothing in these terms limits statutory rights that cannot lawfully be excluded.

Eligibility and Customer Accounts

You are responsible for:

  • Providing accurate account information.
  • Maintaining the confidentiality of account access.
  • Informing us promptly of suspected unauthorised use.
  • Ensuring that information remains current.

We may suspend an account where reasonably necessary to investigate fraud, misuse, security concerns or a breach of these terms.

Product Information

We take reasonable care to describe and photograph products accurately.

Screen settings, lighting and photography may cause minor differences in colour or appearance. Natural ingredients and small-batch production may also result in reasonable variations in colour, aroma or texture.

Such natural variation does not necessarily indicate a defect.

Ingredient lists, quantities, directions and precautions displayed on the physical product or packaging should be checked before use. If online information differs from the product received, contact us before use.

Our products are cosmetics. They are not medicines and are not intended to diagnose, treat, cure or prevent disease. Individual experiences and results may vary.

How the Contract Is Formed

Products displayed on the Site are an invitation to place an order rather than a binding offer by us.

When you submit an order, you make an offer to purchase the selected products. An automated order acknowledgement confirms receipt but does not necessarily mean that the order has been accepted.

A contract is formed when we send a dispatch confirmation, unless we expressly confirm acceptance earlier.

We may decline or cancel an order before acceptance where:

  • A product is unavailable.
  • Payment cannot be authorised.
  • Delivery restrictions apply.
  • Information supplied appears incorrect.
  • We reasonably suspect fraud or misuse.
  • A price or description contains an obvious error.
  • The order appears intended for unauthorised resale.

If payment has been taken for an order we do not accept, it will be refunded.

Prices and Payment

Prices are displayed in the currency selected on the Site and include applicable UK taxes where required.

International currencies may be converted using rates supplied by Shopify, payment providers or financial institutions. Your bank or payment provider may apply its own conversion rate or fee.

Delivery charges, where applicable, are displayed before completion of checkout.

We accept the payment methods shown at checkout, including:

  • Credit and debit cards.
  • Apple Pay.
  • Google Pay.

Payment must be authorised before dispatch.

If a displayed price is clearly incorrect, we may contact you for instructions or cancel and refund the order before dispatch.

Availability

Products are subject to availability.

Placing an item in a basket does not reserve it. If an item becomes unavailable after ordering, we will contact you and refund the unavailable item.

We may limit quantities where reasonably necessary to protect stock availability, prevent fraud or discourage unauthorised resale.

Preparation and Delivery

Please allow up to three working days for order preparation before dispatch.

UK mainland delivery is complimentary and is normally provided through a tracked Royal Mail service.

Express international delivery is available to the United States and selected destinations at the rate displayed at checkout.

DHL may be used for destinations where it is operationally necessary.

Delivery times are estimates unless a guaranteed delivery date has been expressly agreed.

Delivery Addresses and Risk

You are responsible for checking the delivery address before submitting an order.

Contact us promptly if an amendment is required. We will try to assist but cannot guarantee that an address can be changed after preparation or dispatch.

Where we arrange delivery, products remain at our risk until delivered into your physical possession or that of a person identified by you to receive them.

If you independently arrange a carrier that we did not offer, risk may pass when the products are delivered to that carrier, as permitted by law.

International Orders

International customers should check any local import requirements before ordering. We may be unable to fulfil an order where local law, customs requirements or carrier restrictions prevent delivery.

International orders may be subject to:

  • Customs inspection.
  • Import duties.
  • Taxes.
  • Handling or clearance charges.
  • Local restrictions.

Unless expressly included at checkout, these charges are not included in the product or delivery price and are the recipient’s responsibility.

Customs processing may affect estimated delivery times.

Right to Cancel

UK consumers purchasing online normally have the right to cancel an eligible order without giving a reason.

The cancellation period generally ends 14 days after the day on which you, or a person nominated by you, receives the products.

To cancel, send a clear statement to info@finchandhatton.co.uk before the cancellation period expires. Include your name, order number and the products being cancelled.

After notifying us, eligible products must be returned within 14 days.

These cancellation rights are subject to lawful exceptions.

Cosmetic and Hygiene Seals

Where a product:

  • Is supplied with a tamper-evident seal;
  • Is not suitable for return for genuine health-protection or hygiene reasons; and
  • Has been unsealed after delivery,

the statutory cancellation right may not apply to that product.

This exception does not affect rights relating to products that are faulty, unsafe, damaged, misdescribed or incorrectly supplied.

Returns and Refunds

Please contact us for return instructions and the correct returns address before sending a parcel.

Unless the product is faulty, damaged or incorrectly supplied, customers are responsible for the direct cost of returning a cancelled order.

Products should be returned securely packaged. Customers may be responsible for diminished value caused by handling beyond what is reasonably necessary to inspect the product.

We may withhold a refund until we receive the returned products or evidence that they have been sent, whichever occurs first.

Eligible refunds are normally made within 14 days of receiving the returned products or acceptable evidence of return.

Refunds are made to the original payment method. Where a customer paid for delivery, the refund of outbound delivery costs is limited to the least expensive standard delivery method offered, as permitted by law.

Faulty, Damaged or Incorrect Products

If a product is faulty, damaged, unsafe, misdescribed or not what you ordered, contact info@finchandhatton.co.uk promptly with:

  • Your order number.
  • A description of the issue.
  • Photographs where reasonably possible.
  • The product and batch details.

Please retain the product and packaging while we review the matter.

We will provide the remedy required by applicable consumer law. Nothing in these terms reduces your statutory rights.

Product Use and Safety

Products must be used in accordance with the directions, ingredient information and precautions supplied with the individual product and set out in our Product Use & Safety information.

Finch & Hatton oils are topical cosmetics and are not intended for ingestion. Review the complete ingredient list before use, avoid direct contact with the eyes and discontinue use if irritation occurs. Any product-specific directions or precautions shown on the bottle or packaging should always be followed.

    Nothing in this section excludes or restricts Finch & Hatton’s responsibility for a defective or unsafe product or any statutory consumer right.

Website Use and Intellectual Property

The Finch & Hatton name, logos, product names, references, photographs, videos, designs, writing, graphics and Site materials are owned by or licensed to us.

You may use the Site for personal, non-commercial shopping purposes.

You must not, without permission:

  • Copy or republish substantial Site content.
  • Use product photography commercially.
  • Scrape or systematically extract Site data.
  • Misuse the Site or attempt unauthorised access.
  • Introduce malicious code.
  • Impersonate Finch & Hatton.
  • Use our intellectual property to market counterfeit or unauthorised products.

Third-Party Services and Links

The Site may contain links to third-party services, including payment, delivery and social-media platforms.

Those services operate under their own terms and privacy notices. We are not responsible for third-party content that we do not control, although this does not affect our responsibility for services we appoint to fulfil your order.

Our Responsibility

We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill.

We are not responsible for loss that was not reasonably foreseeable when the contract was formed.

Where you purchase as a consumer, we are not responsible for business losses, including loss of profit, revenue, opportunity or business interruption.

Nothing in these terms excludes or restricts liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Defective products where liability cannot be excluded.
  • Breach of statutory consumer rights.
  • Any other liability that cannot lawfully be excluded.

Events Outside Reasonable Control

We are not responsible for delay caused by events outside our reasonable control, provided that we take reasonable steps to reduce the effect of the delay and contact affected customers where appropriate.

If a substantial delay occurs, any cancellation or refund rights provided by law remain available.

Privacy

Personal information is handled according to our Privacy Notice and Cookie Policy.

Shopify, payment providers and other independent services may also process information under their own privacy notices.

Changes to These Terms

We may update these terms to reflect changes in law, technology or business operations.

The terms applying to an order are normally those in force when the order is placed, unless a legal change must apply differently.

Severability and Waiver

If any provision is found invalid or unenforceable, the remaining provisions continue to apply.

A delay in enforcing a right does not waive that right.

Governing Law

These terms are governed by the law of England and Wales.

If you live elsewhere, you retain any mandatory consumer protections provided by the law applicable to you.

Consumers resident in Scotland or Northern Ireland may bring proceedings in their local courts or the courts of England and Wales, as permitted by law.

We will aim to acknowledge the complaint promptly and respond within a reasonable period.
